  • These terms apply to your access and use of the Music Marmalade website (the Website). You should also review our Privacy Policy which explains what personal data we collect when you use our website.

    1. We reserve the right to suspend the operation of our Website at any time. We may also restrict access to some parts of our Website to users who have registered with us.

    3. We may prevent or suspend your access to the Website if you do not comply with these terms or any applicable law.

    4. We may suspend or terminate access or operation of the Website at any time as we see fit.

    5. We do not promise that the Website will be available at all times or that your use of the Website will be uninterrupted.

    6. Whilst we require all users to comply with these Website Terms of Use, we cannot guarantee that all materials uploaded to the Website by other users will comply with these Terms of Use. We will endeavour to remove content that is deemed by us to be in breach of these Terms of Use, but accept no liability for content that users may find to be offensive, harmful, inaccurate or deceptive.

Music Marmalade does not, and is under no obligation to, undertake any identity or criminal record checks of anyone that uses the Website including Clients and Artists.

      3. let us know promptly if you believe that your username or password has been compromised.

    2. We may terminate your access to any Website or any password-protected areas of our Website at any time, if we believe that your use of our Website is affecting the security and stability of our Website or is detrimental to other users.

  4. Intellectual Property Rights

    1. The intellectual property rights in the Website and in any text, images, video, audio or other multimedia content, software or other information or material submitted to or accessible from the Website (Content) are owned by us and our licensors.

  7. Acceptable Use

      3. In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.

      4. To bully, insult, intimidate, harm or humiliate any person.

      6. To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

    2. You also agree:

      1. Not to reproduce, duplicate, copy or re-sell any part of our site.

      2. Not to access without authority, interfere with, damage or disrupt:

        1. any part of our site;

        2. any equipment or network on which our site is stored;

        3. any software used in the provision of our site; or

        4. any equipment or network or software owned or used by any third party.

  8. Content Standards

    1. These content standards apply to any and all material which you contribute to our site (Contribution).

    2. The Content Standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole.

    3. Music Marmalade will determine, in its discretion, whether a Contribution breaches the Content Standards.

    4. A Contribution must:

      1. be accurate (where it states facts).

      2. only contain opinions that are genuinely held.

      3. comply with the law applicable in any country from which it is posted and to which the website is targeted.

    5. A Contribution must not:

      1. Be defamatory of any person.

      2. Be obscene, offensive, hateful, discriminatory, untruthful or inflammatory.

      3. Bully, insult, intimidate or humiliate.

      4. Promote or include sexually explicit material.

    6. For the avoidance of doubt, for any Contribution in the form of video content:

      1. You must tell us immediately, if you upload a video containing any of the following: criminal material (relating to terrorism, sexual exploitation of children, child pornography, racism and xenophobia), unclassified or unclassifiable videos, videos rated R18 or suitable for R18 rating and other material that might impair the physical, mental or moral development of persons under the age of 18 (restricted material).

      2. You must not upload a video containing harmful material.

      3. You must not upload a video containing advertising for any of the following:
        1. cigarettes and other tobacco products, electronic cigarettes or electronic cigarette refill containers, and prescription-only medicine; or
        2. for alcoholic drinks that are not aimed specifically at under 18s and do not encourage immoderate consumption of alcohol.

  9. Limit of Liability

    1. Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:

      1. losses that were not foreseeable to you and us when these terms were formed;

      2. losses that were not caused by any breach on our part;

      3. business losses; and

      4. losses to non-consumers.

  10. Variation to these terms

    1. We reserve the right to amend these terms. Our updated terms will be displayed on the Website. By continuing to use and access the Website, you agree to be bound by any future updates to these terms as and when they are updated. It is your responsibility to check these terms from time to time to verify such variations.

    1. The laws of England and Wales apply to these terms. In which case, you can choose to bring a claim in England and Wales or in the courts of another part of the UK in which you live.
